Credible evidence is must to substantiate claim of loss of profitability; SC sets aside arbitral award in conflict with 'public policy of India'

The Division Bench dismissed the appeal, holding that the arbitral award was in conflict with the 'public policy of India' as defined by Section 34(2)(b) of the Arbitration and Conciliation Act, 1996.
