48. Criminal jurisprudence requires that the liberty of an individual should not be curtailed without sufficient cause. The law of anticipatory bail is a safeguard against the arbitrary exercise of power by the police and is intended to protect the individual from the possibility of being arrested without just cause. The courts must ensure that the power to arrest is not misused and that the rights of the individual are protected.
