The 5-judge Constitution Bench settled the dispute regarding the appointment of members of the Election Commission of India. It held that the Chief Election Commissioner and Election Commissioners shall be appointed by the President on the advice of a 3-member committee comprising the Prime Minister of India, the leader of opposition in Lok Sabha, and the Chief Justice of India. This norm will continue until a law is made by Parliament.
